CERTIFICATION OF DOCUMENTS
(excerpts, certificates, diplomas, and other documents issued by authorities in Canada)

Canada is not a member of the 1961 Hague Convention on the Elimination of the Need for Legalization of Foreign Public Documents, which means that documents issued in Canada for use in Serbia (and vice versa) should be properly legalized.

The Embassy of the Republic of Serbia in Ottawa and the Consulate General of the Republic of Serbia in Toronto certify the signature and seal of the authorized official of the competent authorities of Canada.

When it comes to documents issued in the Republic of Serbia that will be used in Canada, the seal and signature of the authorized official of the Ministry of Foreign Affairs of the Republic of Serbia are entrusted to the Embassy of Canada in Serbia.

 

CERTIFICATION OF SIGNATURE ON POWER OF ATTORNEY OR STATEMENT

Verification of signatures on private documents (powers of attorney for the transfer of real estate rights, statements related to the sale of real estate, powers of attorney related to representation before judicial or administrative bodies, etc.) in Serbian language, for use in the Republic of Serbia, is performed at the Consulate General. In this way, the power of attorney related to inheritance in Serbia, which authorizes a person to make an inheritance statement or take other actions in the probate procedure on behalf of the power of attorney, is also certified

The same procedure applies to inheritance statements by which a person accepts the inheritance that belongs to him / her by law.

Pursuant to the Law on Certification of Signatures, Manuscripts and Transcripts of the Republic of Serbia, identity is established by inspecting an identity card, travel document, driver's license or other official document with a photograph, and if that is not possible, by hearing two identity witnesses (Article 8 of the Law). ).

The identity of a foreign citizen can be established by inspecting a travel document or an identity document issued by a foreign state. (Article 35 of the Notary Rules of Procedure of the Republic of Serbia).
The private document is signed before an official at the Consulate General.

The consular fee for the verification of one signature is 65 CAD. The certification of the signature on the second copy of the same document is 33 CAD, and the certification of the third and each subsequent copy is 20 CAD.

If the signatures of two persons on the same private document are verified, each signature is charged separately.
The consular fee is paid exclusively by debit card.

If the issuer of the power of attorney or statement is not able to come to the Consulate General in person, the private document can be certified by one of the notaries. After the verification of the signature by the notary public, the private document must be certified / signature and stamp / in Official Documents Services (222 Jarvis st,. Toronto) аnd than  at the Consulate General for use before the competent authorities in the Republic of Serbia. The certification of the official seal and signature of a notary public or a Canadian authority is 70 CAD per seal and signature.

Document may be signed before any authorized Canadian notary. In that case, after the verification of the signature by the notary, the document is certified in the Ministry of Foreign Affairs of Canada in Ottawa, and then in the Embassy of the Republic of Serbia in Ottawa.

The consular fee for document verification in this procedure (the so-called "full legalization of the document") is 80 CAD per document.


CERTIFICATION OF INHERITANCE STATEMENTS WHICH DISCLAIMS OF INHERITANCE OR ACCEPT AND AT THE SAME TIME TRANSFERS INHERITANCE TO A THIRD PARTY

These types of so-called. negative inheritance statements can be certified at the Consulate General in the form prescribed by law, which includes a clause on the confirmation of the document (solemnization clause). The personal presence of the issuer of the statement is required, which needs to be identified based on a valid document of the Republic of Serbia (passport or ID card).

If the issuer does not have a valid identification document of the Republic of Serbia, the identity can be determined by inspecting the Canadian identification document (passport, driver's license).

The issuer of the statement is obliged to submit the appropriate text of the statement made by a qualified person in Serbia (lawyer, notary public). The declaration shall be signed at the Consulate General.

The consular fee is paid exclusively by debit card and amounts to 65 CAD for the first copy, or 33 CAD for the second and 20 CAD for the third and each subsequent copy.

The procedure of certifying such a hereditary statement with a clause on the confirmation of the document can take over 30 minutes. The Consulate General recommends that an appointment be made for this type of service by e-mail or telephone.
